The fabric used in "Eclipse" sails is warranted by the fabric manufacture for 5 Years against UV breakdown. (Remedies regarding that warranty would be addressed to them) Shade Sails
LLC warrants the following. SHADE SAILS LLC LIMITED WARRANTY Dear Customer,
Congratulations on your
choice of
a Shade Sail product. This product is guaranteed against defects or
damage
caused by faulty workmanship or materials used in its construction, when used for it’s intended purpose and under normal conditions. This warranty applies for a period of twelve months. Shade Sails also warrants the shade fabric against ultraviolet degradation for a period of two years. In the event of a warranty claim, the customer must notify Shade Sails in writing within one month of the failure warranted against. This warranty, together with the limitations set forth below, represent a bargained for aspect of the product purchased by customer and the warranty limitations are reflected in the purchase price. All limitations herein constitute a bargained for term of purchase. COVERAGE
Your warranty covers
defects in
materials and/or workmanship, which adversely effects the
product’s
ability to
perform or significantly detract from its aesthetic qualities, including fading. 1) Fault Limitations / Installation
There is no warranty
coverage for
damage to the product caused by improper installation. Shade Sails
offers installation services if so desired and customer has opted for
self-installation in order to reduce the cost of the
product. All limitations herein constitute a bargained for term of purchase. Any installation suggestions
offered by Shade Sails are provided as a courtesy only and do not
provide any separate warranty, extension of this warranty or any
other basis for warranty claims. Customer is responsible for all
installationplans, permits, engineering and/or installation related
construction unless otherwise arranged with Shade Sails LLC. Any
damage caused by improper installation (including but not limited to
engineering, permitting, construction, faulty materials, etc.) is
specifically excluded from any warranty claim.
2) Other Damages / Modification
There is no warranty
coverage for
damages caused by improper storage, transport, handling, etc., which
occurs after delivery of the product. No warranty coverage is offered
if purchaser modifies or improperly repairs the product.
3) Implied Warranties
Shade Sails offers no
warranties
beyond the express warranties contained above. This warranty is the
complete and exclusive agreement between purchaser and Shade Sails,
superseding all prior representations. No prior representations, oral
discussions, informational or advisory brochures or other written
correspondences may form a basis for extending this warranty. No
implied warranties beyond those provided by law are offered by Shade
Sails.
Any implied warranties are limited to claims made within one year from the date of purchase. 4) Incidental, Consequential Damages
No provision herein or in
any
prior discussions, brochures and/or writings of any sort shall extend
the liability of
Shade Sails for any incidental or consequential damages; including but not limited to damages or injury to other persons, structures or products, lost profits, the cost of substitute equipment or the claims of third parties. 5) Remedy
In the event of a defect
in
materials and/or workmanship within the warranty period, customer may
return the
product to Shade Sails at customer’s expense, together with a brief, clear statement describing the reason for the return. Shade Sails shall determine whether the warranty applies, and shall then, at their option, either repair or replace the product.
6) Return In
the event any term or provision of this Shade Sails Limited Warranty
is unacceptable to purchaser,
purchaser may elect to return the un-used product within 30 days and shall be entitled to a refund of purchase price. Opened (unfolded) sails must be inspected for re-sale and a 15% re-stocking fee will be charged. Soiled sails or sails that have evidence of use can not be returned. Shade
